Use of collected data
All personal data collected is strictly functional to the stipulation of the contract and the management of related obligations (such as invoicing, debt collection, and fulfillment of tax, accounting, and administrative obligations). The collection of some data, such as that essential for identifying the customer and the place of supply, is mandatory. Failure to collect such data will prevent the stipulation of the contract. The collection of other data, such as that required to apply improved or optimal terms and conditions, is mandatory pursuant to applicable legal and contractual provisions. Failure to collect such data will prevent the stipulation of the contract from being applied.

The personal data collected is processed by the Data Processors listed below and by employees or agents of the undersigned company who need to know such data in order to perform their duties (for example, personnel in the administrative, accounting and manufacturing departments). Your personal data may be disclosed to banks (where applicable) for the management of collections and payments, to third parties appointed to perform activities related and instrumental to this processing, to public authorities and administrations in compliance with legal obligations, to third parties appointed to perform routine and/or extraordinary maintenance of computer archives and to auditing/accounting firms. Your personal data may also be used for marketing purposes by MOCCHETTI GINO INDUSTRIE SOLLEVAMENTI S.R.L. and/or its subsidiaries.

The role of the Data Protection Authority
In terms of privacy protection, this applies to the greater protection of manual or digital data collection in the web sector. It is always for greater protection that the data subject can withdraw from the use of their data after first notifying the data controller. In this regard, they may exercise the right to access, rectify, or erase their data.
These rights are also complemented by the right to restriction of processing, the right to data portability, and the right to lodge a complaint.

Data Protection Authority - Art. 140-bis (Alternative Forms of Protection).
1. If the data subject believes that their rights under data protection legislation have been violated, they may lodge a complaint with the Data Protection Authority or appeal to a judicial authority.
2. A complaint to the Data Protection Authority may not be lodged if, for the same reason and between the same parties, a judicial authority has already been approached
3. Submitting a complaint to the Guarantor renders any further application before a judicial authority between the same parties and for the same subject matter inadmissible, except as provided for in Article
10, paragraph 4 of Legislative Decree No. 150 of September 1, 2011.>>.

- Art.142 Proportionality of the complaint which decides the procedure for submitting a complaint to the interested party or a third party pursuant to Art. 117 of Legislative Decree No. 3 June 2017. The Guarantor shall publish the complaint on its website that violates Articles 15 and 22 of the Regulation.
-Art. 143 Decision on the complaint: once the preliminary investigation has been completed, if the complaint is not unfounded and there are grounds for adopting a measure, the Guarantor may, even before the conclusion of the proceedings, adopt the measures pursuant to Article 58 of the Regulation and Article 56, accepting the related violations.

-Art. 152 on Disputes Articles 78 and 79 of the regulation regarding the application of the legislation on the protection of personal data, as well as the right to compensation for damages pursuant to Article 82 of the same Regulation, are under the jurisdiction of the ordinary judicial authorities.
